Vice Chancellor of Baze University, Abuja, Professor Mamman Tahir, a Senior Advocate of Nigeria, SAN, has said that contrary to the assertion by the Vice President Yemi Osinbajo that he would waive his immunity to be investigated, the Constitution does not allow him to do so.
Speaking on a current affairs program monitored in Lagos on Thursday, Prof. Tahir said the immunity clause in the section 308 of the Constitution is about the office and not about the personality.
He, however, maintained that on a moral ground, the Vice President can allow for an investigation to be done to clear his name.
He said, “Section 308 of the Constitution is not permissive it is mandatory. It’s about the office. It’s not about his personality.
“What he can do is to allow investigation to be carried out and can now clear his name thereafter. After his tenure of office.”
Also corroborating Prof Tahir, a Lagos lawyer , Monday Ubani , said the Vice President cannot waive his immunity.
It will be recalled that the Vice President Yemi Osinbajo yesterday hinted that he would waive his immunity to clear his name over the allegation that he mismanaged N90billion he allegedly took from the FIRS before the 2019 general election.
Timi Frank has also said he is ready to meet the Vice President in the court to prove the allegation against him.
