Tarrif Increment: Electricity Forum Suit Against NERC Stalled
The suit filed by Electricity forum incorporated trustees against the Nigerian Electricity Regulatory Commission, NERC, over increase in Band A tariff was stalled at Federal High court, Ibadan, today , May, 22 2024.
The suit is before Justice Agomah of Federal High court 1, Ibadan.
The case was filed by All Electricity Consumers Protection Forum Incorporated trustees against NERC over their Minor review increase in tariff of Band A category of service based tarrif.
The group lawyer , Charles Afolabi representing the incorporated trustees was in court when the case was called for mentioned while another representative stand in for NERC.
The case was however stalled because the representative of the NERC said he is yet to file response to the suit and claims by the group, forcing the judge to adjourned till July 1, 2024 for hearing.
It will be recalled that on April 3rd, 2024 , the Nigerian Electricity Regulatory commission increase the tariff of Band A under the minor review of MYTO 2014 which received condemnation by consumers and Labor movements among others Including the consumers advocacy group All Electricity Consumers Protection Forum with a letter from its national cordinator, Adeola Samuel – Ilori, who gave the NERC 72 hours ultimatum to reverse the increase or face legal tussle.
In fulfilment of the ultimatum, the group incorporated trustees filed an originating summon asking the court to reverse the order as it’s not according to the extant law and not following procedures earmarked by law before such increase can take place- hence consider it illegal thereby asking the court to so determined and for order of perpetual injuction restraining NERC not to do any increase in future without following the extant laws procedures listed.
